The questions below are the ones we are actually asked, grouped by the situation that prompts them: signing from outside the UAE, Arabic translation, corporate signing authority, what a registrar or bank will accept, and which documents still require attendance in person. Each answer states what the step does and, as importantly, what it does not.

The Questions Clients Actually Ask
A practising lawyer does not automatically become a private notary. Article 31 of Federal Decree-Law No. 20 of 2022 permits a practising lawyer to perform private-notary duties only where the statutory conditions for private-notary admission are satisfied. Our website therefore describes our work carefully as legal advice, drafting, review and coordination of notary-related matters unless a formal notarial act is expressly being performed by the competent authorised notary.
General UAE Notary Questions
What does a notary public do in the UAE?
Under the applicable legal framework, a notary performs defined functions such as notarising certain documents/instruments, authenticating signatures and undertaking other acts within statutory competence. Exact functions depend on the applicable federal or local framework.
Is a lawyer automatically a notary public?
No. Federal law separately regulates private-notary admission. A practising lawyer may perform private-notary duties only if the statutory licensing conditions are satisfied.
Does every UAE contract need notarisation?
No. Some documents require a prescribed form; many contracts do not require notarisation simply to exist. The transaction and applicable law determine the formality.
Can a notarised document still be rejected?
Yes. A registrar, bank, property authority, court or other recipient may require different wording, evidence of authority or supporting documents.
Is online notarisation available in the UAE?
Electronic and remote channels exist in several jurisdictions, but eligibility and process depend on the document and authority.
Power of Attorney Questions
What is a UAE Power of Attorney?
A POA authorises another person to act within stated powers. It should identify the transaction and avoid unnecessary authority.
General POA or special POA: which is better?
Neither is universally better. The correct scope is the narrowest practical authority that safely achieves the intended purpose.
Can a UAE POA cover property?
Yes, subject to transaction-specific wording and the requirements of the competent property authority.
Can a corporate POA be signed by any manager?
No. The proposed grantor must have authority to delegate the relevant powers.
Can a POA be signed outside the UAE?
Often yes, but the overseas execution and authentication route must be suitable for UAE use.
Can a POA be revoked?
Generally, revocation can be possible subject to the instrument, applicable law and any rights already created. Notice to relevant institutions may also be necessary.
Corporate Questions
Does a share transfer only need a notarised agreement?
No. Company/share transfers normally require registrar steps and updated company records.
Do foreign corporate shareholders need legalised documents?
They may. Requirements depend on the registrar, country of origin and transaction.
Is a board resolution the same as a shareholder resolution?
No. The company's governing framework determines which body has authority.
Can corporate clients obtain recurring support?
Yes. Professional arrangements can be discussed based on scope and volume.
Property Questions
Does notarising a property POA transfer ownership?
No. Title transfer is completed through the competent property authority.
Can an overseas owner sell UAE property through a POA?
Potentially, subject to a suitable POA and the property authority's current requirements.
Should a property POA allow the attorney to receive money?
That is a significant power and should be decided expressly after considering the transaction.
Attestation and International Questions
What is document attestation?
Attestation/authentication confirms formal aspects such as seals or signatures for official use; it does not determine every substantive legal effect.
Do foreign documents require Arabic translation?
They may, depending on the receiving UAE authority.
Should I legalise a foreign document before legal review?
Where possible, have the UAE-use wording and recipient requirements checked first.
Is an apostille always enough for UAE use?
Do not assume so. The current legalisation route should be checked for the origin, destination and recipient.
Fees and Timing
Is there one UAE notary fee?
No. Fees depend on the competent authority, document and transaction.
Are legal fees included in government notary fees?
Professional drafting/review charges and official authority fees are different cost categories unless expressly stated otherwise.
How long does notarisation take?
There is no universal time. Review, identity verification, translation, foreign authentication and authority queries can affect completion.
Can urgent processing be guaranteed?
No. The competent authority controls its review and appointment process.
DIFC Questions
Does DIFC have a Notary Service?
Yes. DIFC Courts operates a Notary Service established under its 2025 framework.
Can DIFC notarisation be virtual?
DIFC Courts currently offers virtual, in-person and automated true-copy service options for eligible transactions.
Does DIFC notarisation replace the Registrar of Companies?
No. Corporate registration and notarial functions are distinct.
ADGM Questions
Does ADGM have a Notary Public?
Yes. ADGM Courts Notary Public operates in partnership with Abu Dhabi Judicial Department.
Who can use the ADGM Courts Notary Public service?
ADGM's current FAQ states that its Notary Public service is available for ADGM registered entities; the current service page should be checked for the specific transaction.
Are ADGM documents bilingual?
ADGM's current notary guidance generally requires bilingual Arabic/English documents certified by a UAE-licensed legal translator unless a different language requirement applies.
Declarations and Personal Documents
Can a declaration replace an official certificate?
Not necessarily. A receiving authority may require the official birth, marriage, divorce, education or other source record.
Is parental travel consent always notarised?
Requirements depend on the airline, border authority, destination country and circumstances.
Can an affidavit be notarised?
Affidavits/sworn declarations can fall within notarial services under applicable frameworks, subject to jurisdiction and competence.
Practical Questions
What should I send for review?
Send the draft or instructions, IDs, corporate/property documents where relevant, foreign records and any authority checklist or rejection.
Should I use a free online template?
A template can be a starting point, but high-value or authority-specific documents should be reviewed for the actual transaction.
Can your team guarantee acceptance?
No. The competent authority or third party decides acceptance.
Do you serve clients outside Dubai?
Yes. The office is in Dubai and matters are coordinated across the UAE according to jurisdiction and authority.
Do you work with overseas clients?
Yes. Remote document review and cross-border coordination can be arranged where appropriate.
Is the website legal advice?
No. Website information is general. Matter-specific advice requires review of the facts and documents.
Our Legal Document Approach
We identify the legal outcome first, then the competent authority, signatory capacity, supporting documents, language, authentication requirements and downstream registration. This avoids presenting “notary service” as a single universal procedure.
