That is the whole discipline of property document work in the UAE. Dubai Land Department and other competent property authorities maintain transaction-specific procedures, and they assess the instrument against the transaction in front of them — not against how comprehensive it sounds.

Property Powers Are Not Interchangeable

Sale

A sale POA may need to address representation before the relevant property authority, signing transfer documents and other transaction steps. Whether the attorney may receive sale proceeds, sign settlement documents or appoint another person should be decided expressly — and granted only where the owner actually intends to grant it.

Purchase

Purchase authority can include reservation, transfer, registration and related administrative steps. It should not automatically include borrowing or mortgage powers unless those are genuinely required, since those powers carry a materially different risk.

Mortgage, finance and security

These powers are high-risk. Banks and property authorities may impose their own requirements, and the document should identify the intended finance or security acts precisely rather than describing them in general terms.

Gift

A gift is not simply a sale for zero consideration. Eligibility, relationship, fees, registration requirements and the authority granted to an attorney must all be checked for the relevant property authority, and a sale-style instrument will not usually serve.

Management

Management can include leasing, renewals, maintenance, service-charge matters and dealing with tenants or managers. Powers to sell, mortgage or receive major sums should not be inserted automatically into a management instrument.

Off-plan and handover

Off-plan and handover transactions can involve developers, escrow and payment records, inspection, snagging, keys, utilities and registration. The POA should reflect the actual stage the transaction has reached rather than the transaction as a whole.

Notarisation Does Not Move Title

Notarisation of a POA does not by itself transfer title, register a mortgage or complete a property transaction. It authorises a person to act; the registered transaction is then completed by the competent property authority under its own procedures.

Treating the notarial step as the finish line is the most common cause of a stalled property matter. The instrument is one document in a registration process, and the registry’s requirements govern whether that process completes.

Overseas Owners

Owners outside the UAE often need a UAE-use POA. The execution and authentication route should be planned before signing abroad, so that the final instrument can be accepted for the intended transaction.

The reason is mechanical: the authentication chain and any certified translation are completed on the document as executed. A power discovered to be missing after the chain has run generally cannot be added — the instrument has to be re-executed and re-authenticated in the country of signature.

Frequently Asked Questions

Can one POA cover buying and selling property?

It can be drafted to, but combining them is rarely advisable. Sale and purchase powers carry different risks, and an instrument granting both remains capable of disposing of property after the purchase it was created for has completed.

Does my attorney automatically receive the sale proceeds?

No. Whether the attorney may receive sale proceeds, sign settlement documents or appoint a substitute should be decided expressly in the instrument.

Will a notarised POA complete my transfer?

No. Notarisation of a POA does not by itself transfer title, register a mortgage or complete a transaction. The competent property authority completes the registered transaction under its own procedures.

Can a management POA be used to sell the property?

It should not be. Powers to sell, mortgage or receive major sums are distinct from management powers and should not be inserted into a management instrument automatically.

I am abroad — what should I do first?

Settle the powers required for the specific transaction before signing, then plan the execution and authentication route. Doing it in that order avoids repeating the chain abroad.
